The Faculty of Law and Political Science discussed a master’s thesis entitled “Abusive use of the nodal right / a comparative study”, by the student Saad Abdullah Saleh and supervised by Prof. Dr. Hala Salah Yassin. The study aimed to elicit the opinions of Islamic Sharia scholars on the issue of abuse of the right in general and to show The extent of the effectiveness and flexibility of Islamic law when dealing with emerging jurisprudential issues, the importance of working with jurisprudential rules and the legitimate purposes in this, and the statement of the position of the Iraqi legislator with regard to the abuse of the right in the framework of legal texts and judicial rulings, and laying the foundations for legal texts governing the issue of abuse of the right and its applications to the contract The researcher recommended the necessity of legislating a modern law with regard to the abuse of the right in a clear manner, and that there should be legislative options or explicit legal texts on issues around which opinions and jurisprudence intersect.
